GOOSEN-TUTOR PRESS RELEASE IS WRONG!

Gilroy CA, October 1, 2009

This afternoon Goossen-Tutor Promotions, LLC (“GTP”) issued a press release relating to Robert Guerrero, which misstates the relevant facts. In order to avoid all confusion, here are the facts relative to the dispute between Guerrero and GTP.

1. In March 2003, Guerrero and GTP entered into a promotional agreement which provided for a 5 year term commencing on May 4, 2003 (the GTP Promotional Agreement”).

2. All professional boxing promotional agreements executed in California must include the Commission-approved California Addendum.

3. The California Addendum expressly provides that no promotional agreement may exceed 5 years, and that the terms of the California Addendum control over any conflicting provision in the parties’ promotional agreement. (A copy of the California Addendum, with the relevant provisions marked is annexed hereto may be attained from Team Guerrero Publicist Mario Serrano email: boxingpublicst@aol.com.)

4. In March 2008, prior to the expiration of the 5 year maximum term for a promotional agreement, Guerrero commenced an arbitration before the California State Athletic Commission (the “Commission”) requesting that the GTP Promotional Agreement be terminated on numerous grounds, including substantial, repeated breaches by GTP.

5. Armando Garcia (“Garcia”) was appointed the arbitrator.

6. Two days of evidentiary hearings were held before Garcia.

7. In November 2008, Garcia announced that he had resigned as executive officer of the Commission.

8. On December 15, 2008, an arbitration award (the “Award”) was issued terminating the GTP Agreement. The grounds for termination were: (i) the maximum 5 year period for a promotional agreement had expired; (ii) GTP had failed to obtain a good faith offer of a bout for Guerrero for more than 4 consecutive months; (iii) GTP had failed to obtain the required number of fights for Guerrero as required by the GTP Agreement; (iv) GTP had failed to pay the Guerrero his contractually required minimum purses for his fights against Spend Abazi and Eric Aiken; and (v) GTP violated the Muhammad Ali Act by failing to provide financial disclosures to Guerrero in connection with his fight against Spend Abazi, and that GTP had taken money for such bout which rightfully belonged to Guerrero.

9. The Award was signed by Assistant Executive Director William Douglas “for Armando Garcia.”

10. On December 18, 2008, Guerrero entered into a promotional agreement (the “Golden Boy Agreement”) with Golden Boy Promotions, LLC (“Golden Boy”).

11. The California State Athletic Commission expressly approved the Golden Boy Agreement.

12. On March 25, 2009, GTP filed a petition to vacate the Award on the grounds that Garcia had not rendered the decision.

13. In July 2009, a deposition of Armando Garcia was held. In the morning, Garcia testified that he had not previously read the Award and that he had not reached a final decision in the arbitration.

14. During the afternoon of his deposition, Garcia testified: (i) he had reached tentative or interim decisions on the issues in the arbitration prior to leaving the Commission; (ii) the only difference between reaching a tentative decision and a final decision was that he had not seen the written Award; (iii) that he had now read the Award rendered against GTP, and that if the court concluded that he was still the Arbitrator, he would sign the Award with two minor, non-substantive changes.

15. Garcia further testified during the afternoon of his deposition that: (i) during the course of the arbitration, prior to the issuance of the Award, he had engaged in an ex parte telephone conversation with an employee of GTP where he told such employee that things were “probably going south” for GTP during the arbitration, which Garcia testified meant that GTP was probably going to lose the arbitration;[1] (ii) he intended to apply to be a judge or a referee in Nevada; (iii) one of the commissioners of the Nevada State Athletic Commission was a partner at the law firm which was acting as GTP’s local counsel in connection with the deposition; and (iv) the Nevada State Athletic Commission has the right to approve referees and judges in world title fights.

1 Standard 15(b) of California’s Ethics Standards For Neutral Arbitrators In Contractual Arbitration provides: “An arbitrator must not inform anyone of the award in advance of the time that the award is given to all parties.”

16. On September 29, 2009, the California Superior Court issued a minute order vacating the Award. The Award merely states “Petition GRANTED. California Code of Civil Procedure section 1286.2(a)(1).” The minute order contains no other findings, and contrary to the statements of GTP, the Court’s decision contains absolutely no reference to the GTP Agreement, and contains absolutely no finding that the GTP Agreement is valid or binding. 17. On October 1, 2009, Guerrero informed the California State Athletic Commission that: (i) since the maximum 5 year period for a promotional agreement had expired, there no longer exists any jurisdiction to conduct an arbitration between GTP and Guerrero; and (ii) pursuant to the Commission approved promotional agreement between Guerrero and Golden Boy, Golden Boy is the sole authorized promoter of Guerrero. Guerrero asked that the Commission confirm these facts.

18. On October 1, 2009, GTP issued its latest press release which states that : “There is no court decision or binding arbitration award that has ever allowed Guerrero to sign with any promoter, including Golden Boy Promotions, while he remains under contract with Goossen Tutor.”

19. Goossen Tutor’s press release fails to inform the reader that there is no court decision or binding arbitration award that has ever recognized that Guerrero is still bound to a contract with GTP. In fact, the GTP Agreement expired by its own terms in May 2008.

20. Guerrero is prepared to take all legal action necessary to prevent GTP or any other person from interfering with his Commission-approved promotional agreement with Golden Boy.

Spina-Del Valle headlines Halloween Night show Oct. 31 at Mohegan Sun

PROVIDENCE, R.I. (Oct. 1, 2009) – World-rated light heavyweight Joey “KO Kid” Spina plans to live up to his nickname by knocking out goblins, ghosts, former world champion Lou “Honey Boy” Del Valle and anybody (anything) else that steps into the ring Halloween night at the Mohegan Sun Arena in Uncasville, Conn.

“Fright Night At The Sun” is promoted by Jimmy Burchfield’s Classic Entertainment and Sports, Inc. (CES), in association with Mohegan Sun Casino.

Spina (25-1-1, 17 KOs), fighting out of Providence, takes on Del Valle in the 10-round main event. Joey is rated among the top 15 contenders by all four major boxing organizations – WBC #12, WBA #13, WBO and IBF #14. The rugged Italian-American has defeated former world champion Carl Daniels, The Contender star Jesse Brinkley, Anwar Oshana and Manu Ntoh, among the notables.

Del Valle (36-6-1, 22 KOs), a New York southpaw, has never been stopped in 43 pro bouts. He captured the vacant WBA light heavyweight title in 1997 against European champion “Fast” Eddy Smulders by an eighth-round technical knockout. Lou, who fought Bruno Girard to a draw in their 2001 WBA title fight, went the distance with Roy Jones, Jr. (1998 WBC/WBA unification bout), Virgil Hill (1996 WBA title fight) and Girard (2002 WBA title rematch) in three other world championship matches.

“Joey Spina, pound-for-pound, remains one of the hardest-hitting fighters in the world,” promoter Jimmy Burchfield claimed. “He’s very exciting to watch and fans never know when he’s going to put his opponent to sleep with one big shot. Del Valle has a great chin, though, and he’s held his own against future Hall of Famers like Jones and Hill. A solid performance by Joey against a former world champion like Del Valle should put Spina in line for a major fight. It’s going to be a haunting experience, for sure.”

Also scheduled to fight on “Fright Night At The Sun” is New England and Eastern Boxing Association super bantamweight champion “Machine Gun” Mike Oliver (22-2, 7 KOs), of Hartford, against upset specialist Andre Wilson (11-3-1, 9 KOs) in the 8-round co-feature. A pair of popular, undefeated lightweight prospects are scheduled to be in action, but in 4-round separate bouts, Quincy’s (MA) Ryan “The Polish Prince” Kielczewski (5-0, 2 KOs) and Philadelphia’s Frank Trader (6-0, 2 KOs). All fights and fighters are subject to change.

Gomez and Collins make anticipated returns

Lemoore, Calif. – The return of mixed martial arts at the Tachi Palace Hotel and Casino in Lemoore, Calif. will be especially sweet for two fighters that have called the Palace their home for the last couple years.
Both Phil Collins and Ulysses Gomez waited patiently for a new promotion to take flight at the casino, which is recognized world-wide as the birth place of two of the greatest regional promotions ever formed the WEC and PFC.

Neither has fought for any other promotions, opting to wait for the Palace to move in a new direction.

“This is my home, this is where I’ve always wanted to fight and the Palace has always treated the fighters right,” said Collins, who hails from Merced, Calif. and trains out of Josh Koscheck’s AKA gym in Fresno, Calif. “Really the only thing that’s changed for me is that now the fights are in a cage and with 5-minute rounds. All the same people are there running it like Jeremy (Luchau), Richard (Goodman) and Jacob (Jeff). All those guys have always taken care of me and all the fighters.”

Collins (7-4) will be part of the Tachi Palace Fights inaugural fight card titled “Most Wanted” which takes place Thursday, October 8. He faces a tough middleweight out of Oakland, Calif. Leopoldo Serao (15-7)

Gomez has become one of the brightest stars at the Palace, starting his MMA career at the Central California venue. The Las Vegas, Nev. grappler is considered one of the hottest 125-pound prospects in the world at just 3-1 and will take on Collins’ former teammate at Last Stand Fight Team, Martin Sandoval (4-1) from Oakdale, Calif.

“I’ve seen Sandoval fight before and he’s scrappy, aggressive and maybe a little wild. I know that he’s probably going to want to keep this fight on the feet,” said Gomez, who has three submissions to his credit. “I’ve got somewhat of a game plan, but everyone has one ‘til you get hit in the face.”

Sandoval has been on a hot streak after losing his MMA debut, winning four straight fights all by stoppage.
“They make a lot of hype about Gomez. I mean I know he’s a good grappler, but he gets a lot of attention. I’m just going to go out and do my job and put on a good show,” Sandoval said. “I know he’s going to want to take me down. He doesn’t look like a guy that likes to get out there and bang. I’ve wrestled and I can defend the takedown. Win or lose he will know that he’s been in a good fight.”

The flyweight battle is expected to be an early look at a possible title shot.

“I feel comfortable on my feet and I can keep it there if not we can go to the ground,” said Gomez, who trains his jiu-jitsu at Mark Laimon’s Cobra Kai gym with training partner Simpson Go and his kick boxing with Ken Hahn at Striking Unlimited.

“The first minute will tell me a lot about the fight. I’m not a boxer, so I’m going to be brief.”

Much like the Gomez-Sandoval fight, Collins versus Serao will be a battle of striker against grappler.

“I’m trying to keep the fight standing and if the fight goes to the ground my goal is to not be on my back against this guy,” Collins said. “I’m sure that he’s training harder on his stand up out at Fairtex. We are both working hard on our weaknesses I’m sure.”

Collins and Serao were originally scheduled to fight last May, but an infection forced Serao out of the fight.
“It’s going to be a great fight. My health is 100 percent now. Last time I had a staph infection that went unnoticed, but blew up really fast. Now, I am healthy and ready to fight, no problems,” Serao said. “Anything can happen. We can strike, go to the ground. Phil Collins is well rounded. I will do whatever I need to win.”
The main event of the night pits local wrestling star Hanford, Calif. featherweight Chad Mendes (4-0) against Bend, Ore.’s Mike Joy (7-4). It will be Mendes’ toughest test to date, as the Urijah Faber protégé faces the more experienced Joy.

In the co-main event, Las Vegas, Nev. welterweight War Machine (10-2) takes on Santa Rosa, Calif.’s David Mitchell (7-0).

Doors open at 5:30 p.m. on Thursday and fights start at 6 p.m.

The weighins will take place at the Palace’s Sunset Lounge located on the first floor of the Palace across from the Coyote Grille. Weighins are slated to begin at 5 p.m. and fans are encouraged to come mingle with the fighters.
